1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of KafuDeal, operated from the United Arab Emirates. By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. About KafuDeal

KafuDeal is an online marketplace that helps shoppers in the UAE purchase grocery products that are approaching their expiry date at reduced prices. Products are listed and fulfilled by our partner supermarkets and retailers ("Partners"). KafuDeal provides the platform but is not the seller of the physical goods unless explicitly stated.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract under UAE law to use the Service. By using the Service you confirm that you meet these requirements.

4. Your Account

When you create an account, you agree to:

• Provide accurate, current, and complete information.
• Keep your login credentials confidential.
• Notify us promptly of any unauthorized use of your account.
• Be responsible for all activity that occurs under your account.

We may suspend or terminate your account if you violate these Terms or if we detect suspicious activity.

5. Near-Expiry Products — Important

The products listed on KafuDeal are close to their best-before or expiry date. By purchasing, you acknowledge and accept the following:

• Each product listing shows the expiry date prominently. You are responsible for reviewing it before purchase.
• Products should be consumed before the date shown. We are not liable for products consumed after their expiry date.
• Products remain safe and of merchantable quality up to the displayed expiry date, as represented by the Partner.
• If you receive a product that has already expired at the time of delivery or is visibly damaged, contact us within 24 hours for a refund or replacement.

6. Prices and Availability

Prices are shown in AED and include applicable VAT unless otherwise indicated. Product availability is limited and may change without notice. We reserve the right to correct pricing errors and to refuse or cancel orders at our discretion, including for products listed at an obviously incorrect price.

7. Orders and Payment

When you place an order, you are making an offer to purchase the selected items. The contract is formed when we confirm the order. Payment is processed at checkout by our third-party payment provider. You warrant that any payment method you use is yours and has sufficient funds.

8. Delivery

Delivery is made by our Partners or appointed logistics providers to the address you supply. Delivery times are estimates, not guarantees. Risk of loss transfers to you on delivery. If you are not available to receive delivery, you may be charged a reasonable fee for re-delivery.

9. Returns, Cancellations, and Refunds

Because of the short shelf-life of the products, returns are limited. You may request a refund or replacement in the following situations:

• The product delivered to you was already expired or visibly damaged at the time of delivery.
• The wrong product was delivered.
• Your order was not delivered within a reasonable time after the estimated delivery window.

Requests must be made within 24 hours of delivery via support@kafudeal.com. We may ask for photographs. Approved refunds are issued to the original payment method within 7–14 business days.

10. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of UAE law.
• Resell products purchased through the Service except with our prior written consent.
• Interfere with the operation of the Service or attempt to circumvent our security measures.
• Post content that is abusive, misleading, or infringes the rights of others.

11. Intellectual Property

The Service, including all text, graphics, logos, and software, is owned by KafuDeal or its licensors and is protected by intellectual property laws. You may use the Service for your personal, non-commercial use only. All other rights are reserved.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by UAE law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

To the fullest extent permitted by UAE law, KafuDeal and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount you paid to KafuDeal in the 12 months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless KafuDeal and its Partners from any claims, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service.

15. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates. Any dispute arising out of these Terms or your use of the Service shall be submitted to the exclusive jurisdiction of the competent courts of the UAE.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by a prominent notice on the Service before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
